These Terms and Conditions form the agreement upon which driving lessons and courses are offered to you by Brum Driving School.

By commissioning Brum Driving School for driving tuition you are agreeing to abide by these terms. Please read them carefully. If you are 17 or under, we insist that somebody over the age of 18 reads them with you and countersigns acceptance of the terms.

We may change our terms from time to time and any changes made will take effect straight away. If this happens, we’ll let you know.

1. Tuition

Tuition is only available if:

  • You’re aged 17 or over; and
  • hold a valid UK driving licence (provisional or full) in your own name; and
  • are legally entitled to drive in the UK; and
  • can read a number plate at 20.5 metres (about 5 car lengths) with prescribed visual aids (i.e. contact lenses or glasses) if normally worn

Your driving licence must be produced on or in advance of the first lesson and will be checked using the UK Government’s licence checking tool.

2. Conduct

All instructors employed by or operating under franchise from Brum Driving School are committed to adhering to the Driver and Vehicle Standards Agency’s (DVSA) Approved Driving Instructor (ADI) Code of Practice. Our instructors have pledged to continue their professional development throughout their career. They will be courteous, polite, tidy and punctual and will always behave in a professional and ethical manner.

All instructors’ cars will be maintained and kept clean and tidy as a comfortable learning environment. As part of Brum Driving School’s commitment to the safety of its clients, staff and the general public all instructors’ cars are fitted with dual controls. Instructors will not use lesson time for any other form of business, personal or otherwise.

3. Qualifications

As a minimum qualification, any instructor employed by or operating under franchise from Brum Driving School will be a fully qualified Approved Driving Instructor (ADI), having successfully passed all three parts of the Driver and Vehicle Standards Agency’s (DVSA) testing process.

4. Lessons

Single lessons are a minimum of 60 minutes in length, and a maximum of 90 minutes. Advertised rates, whether online or offline, are based on a rate per hour.

Our instructors employ modern coaching methodology with tuition built upon Client Centred Learning (CCL), to effectively and efficiently achieve driving test success and make you a safe and confident driver.

You and your instructor are responsible for agreeing all matters relating to the dates, timing, location and duration of lessons.

Your instructor will need to speak with you before every lesson to ensure you are free of symptoms relating to COVID-19 and will ask whether you have been in contact with anyone displaying symptoms of COVID-19.

Your instructor will also confirm to you that they too are free of symptoms relating to COVID-19 and have not been in contact with anyone else displaying symptoms of COVID-19.

Your instructor will be following the latest government guidelines on the individuals returning from or arriving into the UK from another country, and the quarantine requirement where advised. During this quarantine period no in person training will take place.

If at any point after a driving lesson you display symptoms of COVID-19 you will alert NHS Test and Trace and follow the latest procedure for testing and guidelines for isolating.

If at any point after a driving lesson your instructor displays symptoms of COVID-19 they will alert NHS Test and Trace and follow the latest procedure for testing and guidelines for isolating.

Important – You must notify Brum Driving School and/or your instructor of any matters which affect your ability or entitlement to receive driving tuition e.g. lack of loss of a valid UK driving licence, medical conditions including the display of symptoms of COVID-19.

5. Punctuality

You are advised to be punctual to any lesson(s) agreed between you and your instructor. To avoid mistakes and/or misunderstandings, the date and time of any lesson(s) agreed between you and your instructor should be recorded.

Waiting time – Your instructor would normally wait a maximum of 15 minutes before the lesson would be abandoned. Any lesson(s) that are abandoned result in the forfeiture of the associated lesson fee or become due for payment at the advertised rate.

If your instructor is delayed due to unforeseen circumstances a reciprocal waiting will be applied. Lost lesson time would be made up by your instructor at the scheduled end time of the lesson should this be possible, or a later date.

6. Lesson Cancellation

If you, Brum Driving School or your instructor want to cancel a lesson, 48 hours minimum prior notice should be given. Should the lesson fall within the 48-hour notice period, Brum Driving School and/or your instructor will rearrange the lesson.

Cancellations made by you must be confirmed with Brum Driving School or directly with your instructor. If 48 hours’ notice of cancellation is not given, the lesson will be charged in full.

Brum Driving School and/or your instructor reserve the right to stop, postpone and reschedule lessons should:

  • It be felt that that the weather or road conditions are unsuitable or dangerous; or
  • you or the instructor feels unwell or be suffering from ill health; or
  • you or the instructor is displaying symptoms of COVID-19 e.g. a cough; or
  • the tuition vehicle develops an unexpected mechanical or safety issue

In person training can recommence once:

  • Your instructor deems the weather or road conditions have improved and do not pose a risk to all parties; or
  • you or your instructor feels well again and/or has sought medical advice; or
  • where appropriate has completed the required quarantine period in line with government guidelines and is no longer displaying symptoms of COVID-19; or
  • the unexpected mechanical or safety issue has been resolved

7. Payments

Payments for driving lessons (individual lessons and block bookings) must be made at least 48 hours in advance.

To book a course, a 50% deposit or the full course fee (if the course start date is within 4 weeks of the booking date) is required. The remaining balance of the course must be paid at least two weeks in advance of the start date.

Once date(s) have been agreed between you and your instructor, should you decide to cancel your tuition any deposits and/or tuition fees paid to Brum Driving School are non-refundable. This does not in any way affect your statutory rights as a consumer.

Should for any reason Brum Driving School and/or your instructor not be able to fulfil any special requirements a full refund will be given.

Payments can be made using one of the following methods:

  • Bank transfer
  • Contactless payment via card reader
  • Credit or debit card online or via invoice link
  • Validated voucher or gift card *

* Vouchers and gift cards can be redeemed by telephoning Brum Driving School on 0121 309 0079. They hold zero cash value and must be redeemed within the validity period and against driving tuition. They are not transferrable once they’ve been redeemed.

Brum Driving School has no responsibility or liability to you for payments made by any other means. If you pay your instructor directly by any method, you should make sure you get a receipt. Brum Driving School accepts no responsibility for any payments made directly to instructors.

8. Price Changes

The cost of pre-paid tuition provided by instructors employed by or operating under franchise from Brum Driving School is based on the lesson price at the time of booking and will be honoured for 12 months afterwards – irrespective of any price increase that may occur between the date of booking and when the lessons are taken. Any unused lessons remaining after 12 months have elapsed will be subject to any lesson price increase applied prior to the lessons which shall become payable by you.

9. Refund Policy and Warranty

You can cancel your pre-paid driving tuition at any time (for the provisions relating to the cancellation of individual lessons see ’Lesson Cancellation’ above).

If you haven’t taken any lesson(s) at the time of cancellation you’ll be entitled to a full refund of any amounts paid to Brum Driving School and/or your instructor, subject to these points:

  • If you’ve taken lesson(s) at the time of cancellation you won’t be eligible for a refund on any lessons taken.
  • Where possible, refunds will be completed using the same method originally used to pay for your lessons. Should for any reason Brum Driving School and/or your instructor are not able to do this, we’ll refund you by the next appropriate method.
  • We may request additional information from you to confirm your identity to comply with the Money Laundering Regulations 2007; we’ll use this information to make sure we follow our Merchant Operating Instructions for card collection facilities.
  • Approved refunds may take up to 10 working days to reach you or your account.
  • Refund of partial block bookings will be made pro rata on any lessons not taken.
  • Refund of partially completed lessons where either your instructor or you begin to display symptoms of COVID-19 will be made pro rata to the nearest 30-minute period.
  • If payment has been made using a voucher or gift card, we won’t be able to offer a refund after redemption of the voucher or gift card.

10. Transferability of Lessons

Lessons that have been purchased in your name cannot be sold or transferred to any other person.

11. Offers, Packages and Discounts

Brum Driving School has a great range of offers, packages and discounts for new and existing learner pupils. We reserve the right to introduce and to withdraw any offer, package or discount from time to time.

Introductory offers are only available to new learner pupils. They can’t be used in conjunction with other offers and aren’t transferable.

12. Learner Comfort and Safety

Footwear and clothing – We advise that suitable footwear and clothing that does not restrict movement, is worn during times of tuition.

Driving under the influence – Brum Driving School and/or your instructor reserve the right to cancel any lesson if you are or your instructor suspects you are under the influence of drugs and/or alcohol.

Medication – You must notify Brum Driving School and/or your instructor of any medication which may affect your ability to receive driving tuition and drive safely.

Instructor control – From time to time, in interests of public and customer safety, your instructor may feel it necessary to exercise control over the tuition vehicle. This may include control of the vehicle via dual control pedals and/or taking charge of the tuition vehicle’s steering wheel.

13. Driving Test

Unless alternative arrangements have been explicitly made it is assumed that you will take your driving test in a tuition vehicle supplied by Brum Driving School or your instructor.

Bookings – Driving tests can be booked by you, Brum Driving School or your instructor. In the event of you having booked your driving test, please notify Brum Driving School or your instructor at the earliest possible opportunity, otherwise vehicle provision for the test date cannot be guaranteed.

Driving test bookings always take priority over other lessons. Brum Driving School and/or your instructor reserve the right to postpone a lesson to allow for other pupil’s driving test bookings, and vice-versa. Brum Driving School and/or your instructor will notify affected parties at the earliest possible opportunity.

Vehicle use – In the interests of public and customer safety, Brum Driving School and/or your instructor reserve the right to withhold the use of a tuition vehicle for the driving test should, in your instructor’s opinion, your driving is actually or potentially dangerous.

Cancellation – In the event of you having booked your driving test, the Driver and Vehicle Standards Agency (DVSA) requires you to give three clear working days to cancel or postpone your test. This may mean that you may lose your test fee if your instructor says you’re not ready for your test within this three-day notice period.

14. Limitation of Liability

Brum Driving School and/or your instructor are not liable to you for any loss or damage caused where, and to the extent that:

  • There’s no breach of a legal duty owed to you by Brum Driving School and/or your instructor;
  • Such loss or damage is not a reasonably foreseeable result of a breach;
  • Any such loss or damage, or increase in loss or damage, results from any breach or omission by you;
  • Any such loss or damage results from circumstances or matters outside of the reasonable control of Brum Driving School and/or your instructor.

In any event, Brum Driving School and/or your instructor shall not be liable for losses relating to any business interest you may have including, without limitation, lost profits, lost earnings, loss of opportunity or business or business interruption.

Nothing in these Terms and Conditions in any way affect your statutory rights as a consumer.

15. Insurance

Brum Driving School and/or your instructor will carry the appropriate motor insurance to provide comprehensive cover should you be involved in a collision as a learner driver, whilst in control of driving a tuition vehicle belonging to Brum Driving School or your instructor.

16. Care and Complaints

In the event of any problem arising, you should first attempt to resolve this directly with your instructor. We recommend you don’t take any further lessons with that instructor until the matter’s resolved.

If you have any concerns or complaints about any part of your driving tuition which can’t be resolved directly with your instructor, please contact us on 0121 309 0079. In the unlikely event that you’re unable to reach a satisfactory conclusion, we’ll be happy to investigate further until the matter is resolved. We’ll require evidence of any financial transactions and lesson times before we’re able to investigate. You should therefore keep your Driver Record (given to you by your instructor) details accurate and up to date.

17. Collection and Use of Data

18. General

‘Force Majeure’ means an event or sequence of events beyond our reasonable control preventing or delaying Brum Driving School and/or your instructor from performing its obligations. Brum Driving School and/or your instructor won’t be liable if delayed in or prevented from performing its obligations under these Terms and Conditions due to Force Majeure.

A waiver of any rights under these Terms and Conditions or law is only effective if it’s in writing and not deemed to be a waiver of any subsequent breach or default. No failure or delay by a party in exercising any right or remedy provided under these Terms and Conditions or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict its further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall prevent or restrict the further exercise of that or any other right or remedy.

If any provision or part-provision of these Terms and Conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification isn’t possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause won’t affect the validity and enforceability of the rest of the terms.

These Terms and Conditions aren’t intended to give rights to anyone except you and Brum Driving School and/or your instructor. The rights of any third parties are specifically excluded.

19. Applicable Law

These Terms and Conditions are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the English and Welsh courts.
